2. BASIC PROVISIONS:
2.1. Matters not regulated in these GTC and the interpretation of these GTC are governed by the laws of Hungary, with particular regard to the relevant provisions of Act V of 2013 on the Civil Code (hereinafter the "Civil Code") and Act CVIII of 2001 on certain issues of electronic commerce services and information society services (E-Commerce Act), as well as the detailed rules of contracts between consumers and businesses (Government Decree 45/2014 (II. 26.). The mandatory provisions of the relevant legislation apply to the contracting parties even without a specific stipulation.
2.2. These GTC take effect on 16 October 2026 and remain in force until revoked. The service provider publishes any amendments to these GTC on the website and notifies registered/previously registered users of the changes by e-mail. Amendments do not affect contracts already concluded, i.e. the amendments are not retroactive.
2.3. The service provider reserves all rights relating to the website, all of its parts and the content displayed on it, as well as the distribution of the website. Without the written consent of the service provider, it is not permitted to download, electronically store, process or sell the content of the website or any part of it.
2.4. The service provider is not liable for the sale or purchase of products published on other websites that are not connected to the service provider and are not operated by the service provider.
3. REGISTRATION/PURCHASE
3.1. In the case of false data, or data that can be linked to another person, provided during the use/ordering/subscription of the service, the entitled party may contest the resulting electronic contract in court. In the case of a successful (winning) contest, the contract becomes invalid from the date of its conclusion or, if it serves as a cover for another contract, the rights and obligations of the contracting parties are determined on the basis of the concluded contract.
3.2. The service provider is not liable for delivery delays or other problems or errors caused by incorrect and/or inaccurate data provided by the user. However, the service provider informs users that, after consultation with and clear identification of the user, it may correct incorrectly entered data in the order so that invoicing and delivery are not hindered.
3.3. The service provider is not liable for any damage caused by the user forgetting their password or by it becoming accessible to unauthorised persons for any reason not attributable to the service provider (if there is registration on the site).
4. RANGE OF PRODUCTS AND SERVICES AVAILABLE FOR PURCHASE, AND THEIR PRICES.
4.1. The products displayed can be ordered online (in some cases by telephone) from the webshop. The prices displayed for the products are in EUR and are gross prices (i.e. they include VAT as required by law or, if the service provider invoices without VAT, the prices are the amounts payable), but they do not include delivery and payment charges. A separate packaging cost will not be charged, unless the user requests decorative or other special packaging.
4.2. In the webshop the service provider provides detailed information on the name and description of the product and displays a photo of the product (where possible).
4.3. If a promotional price is introduced, the service provider will fully inform users about the promotion and its exact duration.
4.4. If, despite all the care taken by the service provider, an incorrect price or a price of EUR "0" or EUR "1" is displayed in the webshop interface due to a system error, the service provider is not obliged to confirm the order at the incorrect price but may reject the offer and offer confirmation at the correct price, in which case the user has the right not to accept the modified offer. An incorrect price means a price at which the Supplier has no contractual intention to conclude a contract. Pursuant to Act V of 2013 on the Civil Code (Civil Code), a contract is concluded by the mutual and concordant expression of the intent of the contracting parties. If the contracting parties cannot agree on the contractual terms, i.e. if there is no mutual and concordant expression of the intent of the contracting parties, no valid contract is concluded from which rights and obligations would arise.

The User may also request the correction of any errors after the order has been sent, by telephone or by e-mail.
5.10. After sending the order, the User receives a confirmation by e-mail. If this confirmation does not reach the User within the period that can be expected given the nature of the service, counted from the sending of the order by the User, but no later than 48 hours, the User is released from the binding offer or contractual obligation. The order and its confirmation are deemed to have been received by the Provider or the User when they become accessible to them. 6. PROCESSING AND FULFILMENT OF ORDERS
6.1. Orders are processed in the order in which the requests are received, during working hours on working days. An order may also be placed outside the times indicated as order processing times, but if the order is placed after working hours, it will be processed on the following working day. In all cases the service provider's customer service confirms electronically when it can process your order.
6.2. General fulfilment deadline: 2–3 working days from the conclusion of the contract.
6.3. Under the contract of sale, the service provider is obliged to transfer ownership of the goods, and the user is obliged to pay the purchase price and take delivery of the goods.
6.4. If the seller is a business and the buyer is a consumer, and the seller undertakes to deliver the goods to the buyer, the risk of loss or damage passes to the buyer when the buyer or a third party designated by the buyer takes possession of the goods. The risk passes to the buyer upon handover of the goods to the carrier if the carrier was hired by the buyer, provided that the carrier was not recommended by the seller.
6.5. In the event of the service provider's delay, the user has the right to set an additional period. If the seller does not perform within the additional period, the buyer has the right to withdraw from the contract.
6.6. The user may withdraw from the contract without prior notice if:
a) the service provider has refused to perform the contract, or
(b) the contract should have been performed at the time agreed by the contracting parties or, because of the recognisable purpose of the service, not at any other time.
6.7. If the service provider does not fulfil its contractual obligation because the product specified in the contract is not available, the service provider informs the user of this without delay and refunds the amount paid without delay, and ensures that the user can enforce their other rights provided by law in the event of defective performance.
6.8. The service provider draws users' attention to the fact that if the user does not take delivery of the ordered product(s) (regardless of the payment method), they thereby breach the contract, specifically under the provisions of Section 6:156 (1) of the Civil Code.
This means that the service provider will also charge users the usual storage costs and the costs of delivery (any cash-on-delivery fee) (return) of the product(s), on the basis of the rules of management of affairs without mandate, unless the consumer expresses their intention to withdraw from the contract (and makes a declaration as to whether they wish to take delivery of the ordered product(s)).
We inform users that the service provider will use the assistance of its lawyers in enforcing all legal claims arising from such a breach of contract, and therefore the user will also be liable for all further (legal) costs (including the fees of the order for payment procedure).
7. RIGHT OF WITHDRAWAL
7.1. Under Directive 2011/83/EU of the European Parliament and of the Council and Government Decree 45/2014 (26.II.) on the detailed rules for contracts between consumers and businesses, the consumer has the right to withdraw from the contract without giving a reason.
The consumer may exercise the right of withdrawal from or termination of the contract
a) in the case of a contract for the sale of goods
aa) of the product,
ab) in the case of the sale of several products, where the individual products are delivered at different times, of the last product delivered,
(ac) in the case of the sale of several lots or items of goods, of the last lot or item delivered,
ad) if the product is to be delivered regularly during a specified period, of the first delivery,
within fourteen days of the day on which the consumer, or a third party other than the carrier indicated by the consumer, takes delivery of the goods.
If the supplier does not comply with this information obligation, the fourteen-day withdrawal period is extended by twelve months. If the service provider provides the information after 14 days from the day of receipt of the product or the conclusion of the contract, but within 12 months, the withdrawal period is 14 days from the day the information is communicated.
7.2. The consumer may exercise the right of withdrawal from the contract by means of an unequivocal statement to that effect or by means of the model declaration set out in Annex 2 to the Government Decree No. 45/2014(26.II.), or by using the withdrawal function.
7.3. The period for exercising the right of withdrawal from the contract expires 14 days after the day on which the consumer, or a third party designated by the consumer other than the carrier, takes delivery of the goods.
7.4. The consumer may also exercise their right of withdrawal from the contract in the period from the day the contract is concluded until the day the product is received.
7.5. The cost of returning the product is borne by the consumer; the service provider has not undertaken to bear this cost.
7.6. When the right of withdrawal from the contract is exercised, no costs other than the cost of returning the product are charged to the consumer.
7.7. The consumer has no right of withdrawal from the contract in the case of a product that is not prefabricated, that was produced on the basis of the Consumer's instructions or at the Consumer's express request, or in the case of a product that has clearly been personalised for the Consumer.
7.8. The consumer likewise may not exercise the right of withdrawal from the contract
a. in the case of a contract for the provision of services, after the service has been fully performed, if the business began performance with the consumer's express prior consent and the consumer acknowledged that they lose the right to terminate the contract once the service has been fully performed;
b. in respect of a product or service whose price or fee is subject to fluctuations in the financial market which the business cannot influence and which may occur during the period within which the right of withdrawal may be exercised;
c. in respect of a product that is perishable or whose quality is short-lived;
d. in the case of a product in sealed packaging that, for health or hygiene reasons, cannot be returned once unsealed after delivery;
e. in respect of a product that, by its nature, is inseparably mixed with other products after transport;
f. alcoholic beverages whose actual value depends on market fluctuations which the business cannot influence and whose price was agreed between the parties at the time of concluding the contract of sale, but where the contract is performed only 30 days after its conclusion;
g. in the case of a contract for services where, at the consumer's express request, the business calls on the consumer to carry out urgent repairs or maintenance;
h. on the sale of a copy of an audio or video recording or computer software in sealed packaging, if the consumer has opened the packaging after delivery;
i. in respect of newspapers, periodicals and magazines, with the exception of subscription contracts;
j. for contracts concluded at a public auction;
k. in the case of a contract for the provision of accommodation, transport, car rental, catering or leisure services, other than services connected with housing, if a specific date or period of performance is stated in the contract;
l. in respect of digital content supplied on a non-tangible medium, if the business began performance with the consumer's express prior consent and the consumer, simultaneously with giving such consent, declared that they acknowledge that they lose the right of withdrawal from the contract once performance has begun.
*|default||szlovak-elallasi-extra|*
7.9. If the supplier withdraws from a distance contract, the business refunds to the consumer without delay, and no later than fourteen days after the day on which it became aware of the withdrawal, the full amount paid by the consumer as consideration, including the costs incurred in connection with performance of the contract. However, the supplier has a right of retention.
7.10. The service provider makes the refund using the same payment method as was used in the original transaction, unless the consumer expressly agrees to another payment method; as a result of the use of this refund method, no additional costs will be charged to the consumer.
7.11. The consumer must return or deliver the goods to the service provider's address without undue delay, and in any event no later than 14 days from the day the notice of withdrawal from the contract is sent to the service provider. If the business also sells the goods at business premises and the consumer exercises their right of withdrawal from the contract in person at the business premises, they are at the same time entitled to return the goods to the business premises.
7.12. In the case of withdrawal from the contract in writing, it is sufficient for the consumer to send the notice of withdrawal within 14 days.
7.13. The consumer meets the deadline if they return or hand over the product(s) before the 14-day period has expired. The return is deemed to have been made in time if the consumer returns the product(s) before the deadline expires.
7.14. The consumer bears only the direct costs connected with returning the product.
7.15. The Supplier is not obliged to reimburse the Consumer for any additional costs resulting from the choice of a delivery method other than the cheapest standard delivery method offered by the Supplier.
7.16. The Supplier may withhold the refund until the goods have been returned or until the consumer provides evidence that they have been returned, whichever is the earlier.
7.17. If the Consumer wishes to exercise their right of withdrawal from the contract, they may do so in writing (by means of the attached declaration), by telephone, or by using the withdrawal function, or in person, at any of the Service Provider's contact details. In the case of written notification by post, the date of dispatch will be taken into account, and in the case of notification by telephone, the date of the telephone notification. The consumer may return the ordered product to the service provider by post, in person or by courier service.
7.18. The consumer is liable only for diminished value resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the product.
7.19. Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses is available here.
7.20. Directive 2011/83/EU of the European Parliament and of the Council is available here.
7.21. The consumer may also contact the service provider with other complaints using the contact details given in these rules.
7.22. The right of withdrawal from the contract applies only to Users who are regarded as Consumers under the Civil Code.
7.23. The right of withdrawal from the contract does not apply to a business, i.e. a person acting within the scope of their profession, independent occupation or business activity.
7.24. (Applicable only if the Service Provider also provides services in addition to sales). If the consumer terminates a distance contract after performance has begun, they pay the supplier a fee proportionate to the service provided up to the date on which the termination is notified to the supplier. The amount payable by the consumer must be determined in proportion to the total amount of the consideration set in the contract, increased by tax. If the consumer proves that the total amount determined in this way is excessive, the proportionate amount is calculated on the basis of the market value of the services provided up to the date the contract ends.
7.25. Procedure for exercising the right of withdrawal from the contract:
7.25.1. If the consumer wishes to exercise the right of withdrawal from the contract, they must notify the Service Provider of their intention to withdraw by contacting the Service Provider.
7.25.2. The consumer exercises their right of withdrawal from the contract in time if they send the notice of withdrawal before the expiry of the 14th day from receipt of the product. In the case of withdrawal in writing, it is sufficient to send only the notice of withdrawal within 14 days. In the case of notification by post, the date of dispatch is taken into account; in the case of notification by e-mail, the date the e-mail was sent is taken into account.
7.25.3. In the event of withdrawal from the contract, the consumer must return the ordered product to the service provider's address, or hand it over to the service provider, without delay and no later than 14 days from the day of the notice of withdrawal. The deadline is deemed to have been met if the product is sent before the 14-day deadline expires (i.e. it does not have to arrive within 14 days). The customer bears the costs incurred in connection with returning the goods as a result of exercising the right of withdrawal from the contract.
7.25.4. However, the Supplier is not obliged to reimburse the Consumer for any additional costs resulting from the choice of a delivery method other than the cheapest standard delivery method offered by the Supplier. The consumer also exercises their right of withdrawal from the contract in the period from the day the contract is concluded until the day the product is received.
7.25.5. In the case of the sale of several products, where each product is delivered at a different time, the buyer may exercise the right of withdrawal from the contract within 14 days of the last product delivered or, in the case of a product consisting of several lots or items, of the last lot or item delivered.
8. GUARANTEE, WARRANTY
Defective performance
The service provider is deemed to have provided a service that does not meet the quality requirements laid down in the contract or in law at the time it was provided. Performance is not regarded as defective if the entitled person knew of the defect at the time the contract was concluded or should have known of it at the time the contract was concluded.
Any provision in a contract between a consumer and a business that deviates from the provisions of this chapter concerning warranty of fitness for purpose and guarantee to the detriment of the consumer is invalid.
Only users who are consumers within the meaning of the Civil Code are entitled to several warranty rights.
User regarded as a business person: a person acting within the scope of their profession, independent occupation or business.
Warranty on accessories
8.1. In which cases may the consumer exercise the right to a warranty on accessories?
In the event of defective performance by the service provider, the consumer may enforce against the service provider a claim under the warranty on accessories in accordance with the rules of the Civil Code.
8.2. What rights does the Consumer have under the warranty on accessories?
The consumer may, at their choice, exercise the following rights under the warranty on accessories: repair or replacement, unless fulfilment of the claim chosen by the consumer is impossible or would entail disproportionate additional costs for the company compared with fulfilling another claim. If repair or replacement was not or could not be requested, they may request a proportionate reduction of the price or, as a last resort, withdraw from the contract. The warranty right on accessories may also be switched to another, but the cost of this switch is borne by the consumer, unless it was justified or the supplier gave cause for it.
The consumer is also entitled to request a proportionate reduction of the consideration or to withdraw from the contract of sale, depending on the gravity of the breach of contract, if:
(a) the supplier has not carried out the repair or replacement, or has carried it out but has wholly or partly failed to dismantle and reinstall the goods, or has refused to bring the goods into conformity with the contract;
(b) a repeated non-conformity has occurred despite the supplier's attempts to bring the goods into conformity with the contract;
(c) the non-conformity is of such gravity that it justifies an immediate price reduction or the immediate termination of the contract of sale, or
(d) the supplier has not undertaken to bring the goods into conformity with the contract, or it is clear from the circumstances that the supplier will not bring the goods into conformity with the contract within a reasonable time or without significant inconvenience to the consumer.
If the consumer wishes to terminate the contract of sale on the grounds of defective performance, the burden of proving that the defect is insignificant lies with the supplier.
The consumer is entitled to withhold the whole of the remaining purchase price, or part of it in proportion to the gravity of the breach of contract, until the supplier has fulfilled its obligations relating to conformity of performance and defective performance.
The reasonable period for repairing or replacing the goods is counted from the day the consumer notified the supplier of the defect.
The consumer must make the goods available to the supplier so that the repair or replacement can be carried out.
In the case of a contract between a consumer and a supplier, the supplier must ensure, at its own expense, that the replaced goods are taken back. If the repair or replacement requires the removal of goods that were put into operation in accordance with their nature and purpose before the defect became apparent, the obligation to repair or replace includes the removal of the non-conforming goods and the installation of the goods supplied as a replacement or the repaired goods, or bearing the costs of removal or installation.
The provision of consideration is proportionate if it equals the difference between the value of the goods to which the consumer is entitled in the case of performance of the contract and the value of the goods actually received by the consumer.
The consumer's right to withdraw from the contract of sale may be exercised by means of a declaration addressed to the supplier, expressing the decision to withdraw from the contract.
If the defective performance concerns only a specific part of the goods delivered under the contract of sale and the conditions for exercising the right of withdrawal apply to those goods, the consumer may withdraw from the contract of sale only in respect of the defective goods, but may also withdraw in respect of any other goods acquired together with them if the consumer cannot reasonably be expected to keep only the goods that conform to the contract.
If the consumer terminates the contract of sale in its entirety or in respect of part of the goods delivered under the contract of sale, then
(a) the consumer must return the goods concerned to the business at the supplier's expense, and
(b) the supplier must refund to the consumer the price paid for the goods concerned immediately after the goods or proof of their return have been received.
8.3. What is the time limit for enforcing the consumer's warranty claim?
The User (if a consumer) must report the defect immediately after discovering it, but no later than two months after the defect is discovered. Please note, however, that a replacement claim cannot be made after the two-year limitation period (one year in the case of business or used goods) from the day of performance of the contract has expired. (For products with an expiry date, the warranty can be enforced until the end of the expiry date).
If, in the case of goods containing digital elements, the contract of sale provides for the continuous supply of digital content or digital services over a specified period, the supplier is liable for any defect of the goods in relation to the digital content or digital services if that defect
(a) in the case of continuous supply for a period not exceeding two years, within two years of the completion of the goods, or
(b) in the case of continuous supply lasting longer than two years,
occurs or becomes apparent.
8.4. Against whom can you enforce the warranty on accessories?
The user may enforce the warranty claim against the service provider.
8.5. What other conditions apply to enforcing rights under the warranty on accessories (if the user is a consumer)?
Within 1 year of the day of performance, there are no conditions for enforcing a claim for damages other than reporting the defect, if the user proves that the product or service was provided by the company operating the webshop. After 1 year from the day of performance, however, the user must prove that the defect identified by the user already existed at the time of performance.
Product warranty
8.6. In what cases may the Consumer exercise their product warranty right, and what rights does the Consumer have on the basis of their product claim?
In the event of a defect in a movable item, the Consumer may, at their choice, exercise their right under the warranty on accessories or enforce a product claim in accordance with the rules of the Civil Code.
Within the framework of the product claim, the consumer may request the repair or replacement of the defective product.
8.7. Against whom can you enforce your product warranty claim?
You may exercise your product warranty rights against the manufacturer or distributor of the product (hereinafter: the manufacturer).
8.8. In what case is a product deemed defective?
A product is defective if it does not meet the quality requirements in force at the time it was placed on the market or if it does not have the characteristics described by the manufacturer.
8.9. Within what period may the consumer enforce their product warranty claim?
The consumer may enforce a product claim within two years of the product being placed on the market by the manufacturer. After this deadline you lose this right.
8.10. Against whom and under what further conditions can a product warranty claim be enforced?
A product warranty claim can be enforced only against the manufacturer or distributor of the movable item. The user must prove that the product is defective in order to enforce a claim arising from the product warranty.
8.11. In which cases is the manufacturer (distributor) released from its obligation to provide a product warranty?
The manufacturer (distributor) is released from its product warranty obligation only if it can prove that:
- the product was not manufactured or placed on the market in the course of its business activity, or
- the defect was not detectable according to the state of science and technology at the time the product was placed on the market, or
- the defect of the product is caused by the application of a law or a mandatory standard laid down by a public authority.
The manufacturer (distributor) need prove only one ground for release.
Please note that the warranty on accessories and the product warranty cannot be enforced simultaneously for the same defect. However, if the product warranty claim is successful, you may enforce the warranty on accessories against the manufacturer for the replaced product or the repaired part.
Guarantee (in the case of new durable consumer goods)
8.12. In what case may the consumer exercise rights under the guarantee?
In the event of defective performance, the Service Provider is obliged to provide a guarantee under Government Decree 151/2003 (IX. 22.) on the mandatory guarantee for certain durable consumer goods, if the user is regarded as a consumer.
The following are regarded as a consumer:
a) a consumer under Act V of 2013 on the Civil Code (hereinafter the “Civil Code”), or
b) a micro, small or medium-sized enterprise acting outside the scope of its business activity, independent practice of a profession or commercial activity.
A micro, small or medium-sized enterprise acts outside the scope of its business activity, independent practice of a profession or commercial activity if it acquires the consumer goods in the course of retail activity under the Act on Trade, irrespective of whether the consumer goods are accounted for within its economic activity.
8.13. What rights does the consumer have under the guarantee, and within what time limits?
The guarantee period is:
a) two years in the case of a selling price of at least HUF 10,000 but not exceeding HUF 250,000;
b) three years in the case of a selling price exceeding HUF 250,000.
Failure to observe these time limits results in forfeiture of rights.
The guarantee period begins on the day the consumer goods are handed over to the consumer or, if installation is carried out by the Service Provider, its agent or another authorised person, on the day of installation.
If the consumer has the consumer goods installed after six months have passed since their handover, the start of the guarantee period is the day the consumer goods were handed over.
The consumer may, at their choice, report the claim for repair at the registered seat of the Service Provider, at any of its places of business or branches, and directly at the service centre indicated on the guarantee certificate.
On the basis of the guarantee claim, the entitled person may, at their choice:
request repair or replacement, if fulfilment of the chosen guarantee right is not impossible or would not entail disproportionate additional costs for the obligated person compared with another guarantee claim, taking into account the value of performance without defect, the gravity of the breach of contract and the harm caused to the entitled person; or
request a proportionate reduction of the price or withdraw from the contract, if the obligated person has not undertaken the repair or replacement, cannot fulfil this obligation (...), or if the entitled person's interest in repair or replacement has ceased.
Withdrawal from the contract is not permitted in the case of an insignificant defect.
The aim must be to complete the handling within 15 days
Pursuant to Section 5 of NGM Decree 19/2014 (IV. 29.) on the procedural rules for handling warranty and guarantee claims relating to items sold under a contract between a consumer and a business, the Service Provider must endeavour to carry out the repair or replacement within 15 days at the latest. If the repair or replacement takes longer than 15 days, the Service Provider must inform the consumer of the expected duration of the repair or replacement. The information is provided, with the consumer's prior consent, electronically or in another manner suitable for proving delivery.
If it turns out that the product cannot be repaired
If, during the guarantee period, the Service Provider establishes upon a failure of the consumer goods that they cannot be repaired, the Service Provider must – unless the consumer provides otherwise – replace the consumer goods within 8 days. If replacement is not possible, the Service Provider must refund the purchase price to the consumer within 8 days.
If the product fails for the fourth time
If, during the guarantee period, the consumer goods fail again after three repairs, the business must – unless the consumer provides otherwise – replace the consumer goods within eight days. If replacement is not possible, the business must refund to the consumer within 8 days the purchase price indicated on the guarantee certificate or, if that is not available, on the proof of payment presented by the consumer (an invoice or receipt issued under the Act on Value Added Tax).
If repair is not carried out within 30 days
If the repair of the consumer goods does not take place within 30 days of the guarantee claim being communicated to the business, the business must – unless the consumer provides otherwise – replace the consumer goods within 8 days of the unsuccessful expiry of the thirty-day period. If replacement is not possible, the business must refund to the consumer within 8 days of the unsuccessful expiry of the 30-day repair period the purchase price indicated on the guarantee certificate or, if that is not available, on the proof of payment presented by the consumer (an invoice or receipt issued under the Act on Value Added Tax).
8.14. When is the business released from its guarantee obligation?
The Service Provider is released from its guarantee obligation only if it proves that the cause of the defect arose only after performance. Please note that, for the same defect, the consumer may enforce a claim under warranty for defects and a guarantee claim, as well as a product liability claim and a guarantee claim, simultaneously and in parallel. However, once the consumer has successfully enforced a claim arising from defective performance on account of a particular defect (for example by replacement of the product), they cannot enforce a further claim on another legal basis for the same defect.
8.15. After the guarantee period (professionally expected service life) has expired, the Service Provider is not liable under the guarantee for damage resulting from natural wear and tear or obsolescence.
8.16. Furthermore, the Service Provider is not liable under warranty for defects or under the guarantee for damage arising after the passing of risk from incorrect or careless handling, excessive use, exposure to effects other than those specified, or other use of the products contrary to their purpose.
8.17. If, due to a defect in the consumer goods, the consumer makes a replacement claim within three working days of the purchase or of the installation, the Service Provider may not invoke disproportionate additional costs under Section 6:159 (2) a) of the Civil Code and must replace the consumer goods within eight days, provided that the defect prevents proper use. If replacement is not possible, the business must refund to the consumer without delay the purchase price indicated on the guarantee certificate or, if that is not available, on the proof of payment presented by the consumer (an invoice or receipt issued under the Act on Value Added Tax).
8.18. What further requirements may be imposed as a condition for exercising guarantee rights?
Special requirements (for example periodic inspection) may be imposed on the consumer to ensure the proper installation or use of the consumer goods, if proper installation or use cannot be ensured in any other way and fulfilling these requirements does not place a disproportionate burden on the consumer.
9. PROCEDURE TO BE FOLLOWED IN THE EVENT OF A WARRANTY CLAIM
(FOR USERS WHO ARE CONSUMERS)
9.1. The agreement of the contracting parties between the consumer and the supplier may not deviate from the provisions of the decree to the detriment of the consumer.
9.2. The consumer is obliged to prove the conclusion of the contract (by an invoice or even just a proof of purchase).
9.3. The costs related to fulfilling the guarantee obligation are borne by the service supplier (Civil Code, Section 6:166).
9.4. The supplier keeps a record of the warranty or post-warranty claims that the consumer has reported to it.
9.5. A copy of the record is made available to the Consumer without delay and in a verifiable manner.
9.6. If the supplier cannot state at the time of notification whether the consumer's warranty or post-warranty claim can be fulfilled, it informs the consumer of its position, including the reasons for rejecting the claim and the possibility of turning to a conciliation board, in a verifiable manner within five working days.
9.7. The supplier keeps the record for three years from the day it was drawn up and presents it at the request of the supervisory authority.
9.8. The supplier must endeavour to carry out the repair or replacement within fifteen days at the latest. If the repair or replacement takes longer than 15 days, the service provider must inform the consumer of the expected duration of the repair or replacement. The information is provided, with the consumer's prior consent, by electronic means or in any other manner that the consumer can use as proof of receipt.
10. MISCELLANEOUS PROVISIONS
10.1. The supplier is entitled to use a subcontractor to perform its obligations. The supplier bears full responsibility for any unlawful conduct of the subcontractor as if it had committed the unlawful conduct itself.
10.2. If any part of these terms becomes invalid, unlawful or unenforceable, the validity, lawfulness and enforceability of the remaining parts are not affected.
10.3. If the supplier does not exercise any right to which it is entitled under these terms, the failure to exercise such a right is not regarded as a waiver of that right. No waiver of a right is valid unless expressly stated in writing. The fact that the service supplier on one occasion does not strictly comply with an essential condition of the rules does not mean that it waives its right to insist on strict compliance with that condition in the future.
10.4. The service supplier and the user shall try to settle their disputes amicably.
10.5. The contracting parties have agreed that the service supplier's webshop is located in Hungary and is maintained in Hungary. As the site may also be visited from other countries, users expressly acknowledge that the law governing the relationship between the user and the supplier is the legislation of Hungary. If the user is a consumer, then under Section 26 (1) of the Code of Civil Procedure the court of the defendant's (the consumer's) place of residence has exclusive jurisdiction in disputes arising from this contract.
10.6. The service provider does not apply different general conditions of access to the products in the webshop for reasons related to the user's nationality, place of stay or residence.
10.7. The service provider does not apply different conditions to the payment transaction for the payment methods it accepts, for reasons related to the user's nationality, residence or place of establishment, the location of the payment account, the place of establishment of the payment service provider or the place of issue of the cash-substituting payment instrument within the European Union.
10.8. The service provider complies with REGULATION (EU) 2018/302 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 20 December 2018 on addressing unjustified geo-blocking and other forms of discrimination based on customers' nationality, place of residence or place of establishment within the internal market and amending Regulations (EC) No 2006/2004 and (EU) 2017/2394 and Directive 2009/22/EC.
11. COMPLAINT HANDLING PROCEDURE
(FOR USERS WHO ARE CONSUMERS)
11.1. The service provider's aim is to fulfil all orders to the full satisfaction of the customer and in satisfactory quality. If the user has any complaint about the contract or its performance, they may report it by telephone, e-mail or letter.
11.2. The service provider examines an oral complaint without delay and remedies it as necessary. If the customer does not agree with the handling of the complaint or if the complaint cannot be investigated immediately, the service provider draws up a record of the complaint and of its position on the complaint without delay and provides the customer with a copy of the record.
11.3. The service provider replies to a written complaint in writing within 30 days, in a manner that can be substantiated on the merits, and arranges for the reply to be communicated. The reasons for rejecting the complaint are stated. The service provider keeps the record of the complaint and a copy of the reply for 3 years and presents them to the supervisory authorities on request.
11.4. We inform you that, if your complaint is rejected, you may turn to a public authority or a conciliation board, as set out below (the service provider has made no general declaration regarding the submission of complaints):
11.5. The consumer may lodge a complaint with the consumer protection authority:
Pursuant to Section 45/A (1)–(3) of the Consumer Protection Act and Government Decree 387/2016 (XII. 2.) on the designation of the consumer protection authority, the government office acts as the general consumer protection authority:

11.7. The conciliation board is responsible for the out-of-court settlement of consumer disputes. The task of the conciliation board is to attempt to reach an agreement between the parties in order to resolve the consumer dispute and, if this is unsuccessful, to decide the matter in order to ensure that consumers' rights are enforced in a simple, fast, effective and cost-efficient manner. At the request of the consumer or the supplier, the conciliation board gives advice on the rights and obligations of the consumer.
In conciliation proceedings, in the absence of an agreement, the panel decides on the merits of the case and
(a) issues a decision imposing an obligation, if
aa) the request is well founded and the supplier, as registered with the conciliation board or the chamber or as stated in its commercial communications, in compliance with the provisions of Section 36/C, in its general declaration of submission under Section 36 (1), at the start of the proceedings or in a declaration made no later than the day the decision is adopted, has recognised that it is bound by the decision of the conciliation board, or
ab) the supplier has not made a declaration of submission, but the request is well founded and the consumer's claim to be enforced does not exceed HUF 250,000, either in the request or at the time the decision imposing an obligation is adopted, or
(b) makes a recommendation if the request is well founded but the supplier stated at the start of the proceedings that it does not recognise the panel's decision as binding, or did not state at all that it recognises the panel's decision.
11.8. In the case of cross-border consumer disputes relating to online sales or online service contracts, all conciliation boards operated by the county (in the capital, Budapest) chambers of commerce and industry may act, taking into account the rules of jurisdiction laid down in Section 20 of the Act on the protection of consumers' rights and freedoms.
11.09. The service provider is obliged to cooperate in the conciliation proceedings. The service provider is obliged to make use of the conciliation proceedings. In this connection the service provider sends its reply to the conciliation board and ensures the participation at the hearing of a person authorised to reach a settlement. If the place of business or establishment is not registered in the district of the chamber of the competent territorial conciliation board, the service provider's duty of cooperation includes offering the possibility of a written settlement in accordance with the consumer's request.
11.10. If the consumer does not turn to a conciliation board or if this procedure was unsuccessful, the consumer has the right to turn to a court in order to resolve the dispute. The lawsuit must be initiated by a statement of claim containing the following information:
- the competent court;
- the names, places of residence and status of the parties and their representatives;
- the right to be enforced, setting out the facts on which it is based and the evidence in support of those facts;
- the data from which the competence and jurisdiction of the court can be derived;
- a request for a final decision of the court.
The document, or a copy of the document, whose content is relied on in support of the claim must be attached to the statement of claim.
